1. About these terms

These terms are an agreement between you and [operator name to be confirmed] (ABN [ABN to be confirmed]), which operates AskUncleX ("we", "us", "our"). By creating an account or using AskUncleX, you agree to them. Our Privacy Policy explains how we handle your information.

3. Who can use AskUncleX

You must be 18 or over and in Australia. You may use AskUncleX for your own disputes, and letters are written in your name.

4. Your account

Give us accurate details, keep your password to yourself, and tell us promptly if you think someone else has used your account. You are responsible for what happens in your account unless it happens because of our failure.

5. How it works and what you pay

You can upload a document and build your case for free. To receive your dispute letter, you pay the price shown before you pay. It is a one-off payment for that letter, in Australian dollars, and includes any GST that applies. There is no subscription.

You will see the AI's assessment of your case, including when it rates the case as weak, before you decide to pay. The price is the same whatever that assessment says. Payments are processed by Stripe, and your card details go to Stripe, not to us.

No one can guarantee the outcome of a dispute. The company or authority you write to makes its own decision.

6. Refunds and your consumer rights

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.

If you pay and we don't deliver a letter written for your case, we will refund you. Beyond your rights under the Australian Consumer Law, we don't give refunds because a dispute was unsuccessful or because you changed your mind. To ask for a refund, email [contact email to be confirmed].

7. Your documents and information

You keep ownership of everything you upload and type. You let us store, copy, process and send it to our service providers, only as needed to run AskUncleX for you and as described in our Privacy Policy.

Only upload documents you are entitled to use, and include other people's personal information only where your dispute needs it.

8. Using AskUncleX fairly

You must not use AskUncleX to:

  • make claims you know are false or misleading, or create, alter or forge documents;
  • harass, threaten or defame anyone;
  • act for someone else without their permission;
  • upload anything unlawful, or any virus or malicious code;
  • get around our security, or access accounts or data that are not yours;
  • copy or scrape AskUncleX, or create accounts or cases by automated means; or
  • resell AskUncleX, or use it in a way that overloads it or harms other users.

9. Your letter and our platform

Once you have paid for a letter, you may use, edit and send it however you like. Everything else that makes up AskUncleX — the software, design, brand and content — belongs to us or our licensors.

10. Closing your account

You can stop using AskUncleX at any time and ask us to delete your account, as our Privacy Policy explains.

We may suspend or close your account if you seriously break these terms, or if we need to for security or legal reasons. Where we reasonably can, we will tell you first and explain why. If we close your account for any reason other than your breach, we will refund any letter you have paid for and not received.

11. Changes

We may make reasonable changes to AskUncleX and to these terms. A change to these terms applies only from when it takes effect. If a change is significant, we will email you at least 14 days beforehand. If you don't agree with it, you can stop using AskUncleX, close your account, and we will refund any letter you have paid for and not received. A change never affects a letter you have already paid for.

12. Our responsibility to you

Nothing in these terms excludes, restricts or modifies your rights under the Australian Consumer Law or any other law that cannot be excluded. Subject to those rights, we are not responsible for loss that is not a reasonably foreseeable result of our breach, or for decisions made by the company or authority you are disputing.

13. Complaints

If something has gone wrong, email [contact email to be confirmed] and we will aim to respond within 10 business days. If you are not satisfied, you can contact your state or territory's fair trading or consumer affairs office, or the Australian Competition and Consumer Commission.

14. General

These terms are governed by the laws of [state or territory to be confirmed]. If any part of them is invalid, the rest still applies. We may transfer these terms to someone who takes over AskUncleX, and we will tell you if we do; your rights under them do not change. To contact us, email [contact email to be confirmed].
